1. Acceptance of Terms

By accessing or using OculiRX ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

OculiRX provides an at-home vision acuity testing platform that enables users to measure their visual acuity and receive prescription renewals reviewed by licensed eye care professionals. The Service is intended for adults aged 18-65 who meet our eligibility criteria.

3. Medical Disclaimers

Important: OculiRX is a screening tool for visual acuity only. It is NOT a replacement for comprehensive eye health examinations and cannot detect eye diseases, glaucoma, cataracts, macular degeneration, or other conditions.
  • The Service is for prescription renewals only, not new prescriptions
  • The Service does not measure or prescribe contact lens parameters
  • Results are subject to review and may be rejected if the reviewing physician determines the test is invalid or a comprehensive exam is needed
  • You should continue regular comprehensive eye exams as recommended by your eye care provider (typically every 1-2 years)
  • Seek immediate in-person care for eye pain, sudden vision changes, flashes of light, new floaters, or eye injury

4. Eligibility

To use the Service, you must:

  • Be between 18 and 65 years of age
  • Have an existing glasses prescription that you are renewing (not obtaining for the first time)
  • Have had a comprehensive eye exam within the past 2-5 years (varies by state)
  • Not have any conditions that contraindicate remote vision testing (see our eligibility guidelines)
  • Have access to a computer, tablet, or device with a working webcam
  • Be located in a state where our service is available

5. User Responsibilities

You agree to:

  • Provide accurate and truthful information in your medical questionnaire
  • Follow all test instructions carefully and honestly
  • Not attempt to cheat, manipulate, or game the testing process
  • Take the test in appropriate conditions (adequate lighting, proper distance, no distractions)
  • Maintain the confidentiality of your account credentials
  • Not share, sell, or transfer prescriptions issued through the Service
  • Report any technical issues or concerns about your results promptly

6. Fees and Payment

  • The current fee for a vision exam is $49 USD, payable at the time of service
  • Payment is processed securely through Stripe
  • Refunds are available if you are not satisfied with the service or if your exam is rejected by the reviewing physician
  • We do not currently accept insurance, but you may submit receipts to your FSA/HSA
  • Prices are subject to change with notice

7. Prescriptions

  • All prescriptions are reviewed and signed by a licensed optometrist or ophthalmologist
  • Prescriptions are valid for the period specified by the issuing physician (typically 1-2 years), subject to state regulations
  • You own your prescription and may use it at any eyewear retailer
  • The reviewing physician has sole discretion to approve, modify, or reject a prescription based on their clinical judgment
  • If your exam is rejected, you will receive a full refund and recommendation to seek in-person care

8. Video Recording Consent

By using the Service, you consent to video recording of your exam session. These recordings are:

  • Required for the reviewing physician to verify your results
  • Protected as part of your medical record under HIPAA
  • Retained for quality assurance and regulatory compliance
  • Never shared publicly or used for marketing without consent

9. Intellectual Property

All content, software, technology, trademarks, and other intellectual property associated with the Service are owned by OculiRX or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Service without written permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCULIRX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless OculiRX from any claims, damages, or expenses arising from your violation of these Terms, your misuse of the Service, or your provision of false information.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, you will still be able to access your medical records as required by law.
